Official fees are likely to increase from October 2020
In May 2019, The Institute of Patent and Trade Mark Attorneys of Australia and others provided feedback on the current fee structure to the Fee Review Panel of IP Australia.
In particular, IPTA recommended the following changes in relation to official fees for trade mark matters:
a reduction of fees applicable to multi-class applications and registrations;
an official fee for filing a Notice of Intention to Defend (to reduce the number of undefended oppositions);
a revision of the Scale of Costs awarded in oppositions to more closely reflect the actual costs incurred;
discounts for “small entities” to improve access to IP protection for individuals and SMEs.
All of these suggestions have merit and it remains to be seen which, if any, will be implemented, probably in October 2020.
